Welcome to AlfareedCard. These Terms and Conditions (“Terms”) form a legally binding agreement between you (“you,” “your,” or “user”) and AlfareedCard (“Company,” “we,” “us,” or “our”), governing your access to and use of our website, mobile application, and related services, content, and features (collectively, the “Services”).

By accessing, browsing, registering, or otherwise using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must immediately discontinue use of the Services.

You may opt out of this agreement at any time by ceasing use of the Services and, if applicable, deleting your account. However, any rights and obligations accrued prior to your opt-out — including, but not limited to, transactions, disputes, intellectual property, indemnities, and limitations of liability — will remain in effect and continue to bind you for a period of one (1) year following the date of your opt-out or account closure, or for as long as required by applicable law, whichever is longer.

We reserve the right to modify, update, or revise these Terms at any time. Such changes will be effective immediately upon posting unless otherwise indicated. Your continued use of the Services following the posting of revised Terms constitutes your acceptance of those changes. It is your responsibility to review the Terms periodically.

1. User Eligibility & Account Registration

1.1 Eligibility

By using AlfareedCard services, you confirm that you are legally capable of entering into a binding contract and meet the minimum age requirement of 18 years or older as applicable under UAE law. If you are under the legal age in your jurisdiction, you may only use the Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

1.2 Account Registration

To access certain features of AlfareedCard, you may be required to create an account. When registering, you agree to:

Provide accurate, complete, and up-to-date information at all times.
Maintain the confidentiality of your account credentials, including your username and password.
Notify us immediately of any unauthorized use of your account or any security breach.

1.3 Account Responsibility

You are solely responsible for all activity that occurs under your account. AlfareedCard is not liable for any losses or damages resulting from unauthorized use of your account due to your failure to safeguard your login credentials.

1.4 Account Termination

We reserve the right to suspend or permanently terminate accounts that violate these Terms, engage in fraudulent activities, or remain inactive for an extended period, in accordance with applicable UAE laws.

2. Use of Our Services

2.1 Personal, Non-Commercial Use

The Services provided by AlfareedCard are intended for personal, non-commercial use only. You may browse, access, and purchase digital cards, games, eSIMs, or other products for your personal benefit. Commercial use — including resale, distribution, or unauthorized marketing — is strictly prohibited without prior written consent from AlfareedCard. Unauthorized commercial use may result in account suspension or termination and other legal remedies.

2.2 Prohibited Conduct

By accessing and using AlfareedCard, you agree to comply with all applicable laws and these Terms. You must refrain from any conduct that may compromise the security, performance, or integrity of our Services. Prohibited activities include, but are not limited to:

Violating applicable laws, regulations, or third-party rights.
Infringing on intellectual property, privacy, or proprietary rights of any party.
Interfering with or disrupting platform operation, security, or functionality.
Attempting unauthorized access to accounts, systems, or data.
Using automated systems (e.g., bots, scrapers) without express permission.
Impersonating any person or entity, or misrepresenting your affiliation.
Submitting false, misleading, or fraudulent information.
Harassing, abusing, threatening, or harming other users or staff.

Violation of these rules may result in immediate account suspension or termination and potential civil or criminal legal action under applicable UAE law.

2.3 User Content and Communications

You may interact with other users through reviews, messaging, or feedback. While AlfareedCard strives to maintain a secure and respectful environment, we do not control or guarantee the conduct, content, or accuracy of communications between users. You acknowledge that:

Any interactions are solely your responsibility.
AlfareedCard is not liable for any loss, damage, or disputes arising from user interactions.
You must exercise caution, good judgment, and discretion when engaging with others.

2.4 Reporting Violations

Users are encouraged to report suspicious behavior, inappropriate content, or violations of these Terms. Reports can be submitted to our Customer Support Team or via available in-platform reporting tools. AlfareedCard may review reported incidents and take appropriate action, including content removal, account suspension, or notifying authorities.

2.5 User Safety Guidelines

Do not share sensitive personal information through unsecured channels.
Avoid engagement with threatening or deceptive users.
Verify the identity and legitimacy of service providers before proceeding with any exchange.

2.6 Wallet Services

AlfareedCard provides a digital wallet (“AlfareedCard Wallet”) to store credits, refunds, promotional balances, or other eligible funds associated with your account. The following conditions apply:

The Wallet is accessible only via your registered account for personal, non-commercial use.
Funds may be used solely for purchases on AlfareedCard, unless otherwise specified.
You are responsible for maintaining Wallet credentials and all activity under your account.
Refunds from eligible returns may be credited to your Wallet unless reimbursement to your original payment method is requested, subject to our Refund Policy.
Promotional credits or loyalty rewards may be subject to expiration or usage restrictions as disclosed.
Wallet balances are non-transferable between accounts and may not be exchanged for cash unless required by law.
AlfareedCard reserves the right to monitor Wallet usage and suspend or terminate access in cases of suspected fraud, abuse, or violation of these Terms, Misuse may result in account restrictions or legal action.

2.7 Accuracy of Information and Compliance

You must provide current, complete, and accurate information during registration, checkout, and communications. In cases requiring customs processing, you are responsible for providing necessary information and complying with all import laws and regulations. Alfareed Card is not liable for delays, duties, taxes, or fees imposed by customs authorities. Providing false, misleading, or incomplete information may lead to account suspension, termination, and legal liability.

3. Errors and Inaccuracies

AlfareedCard strives to provide accurate, up-to-date information regarding all digital cards, games, eSIMs, and related services listed on our platform. We make every effort to ensure that descriptions, images, pricing, availability, and specifications are accurate and complete. However, we do not warrant that all content on the website is error-free, complete, current, or without variation.

Correction of Errors

We reserve the right to correct any errors, inaccuracies, or omissions and to update or change information at any time without prior notice. This includes updates to product availability, pricing, descriptions, and promotional offers, even after an order has been submitted.

Changes to Features and Content

All features, content, specifications, and prices of products and services are subject to change at any time without notice. Certain weights, measurements, and descriptions are approximate and provided for convenience only.

Suitability and Responsibility

We make no guarantees regarding the suitability of any product or service for your particular needs. It is your responsibility to review product or service descriptions carefully and, where applicable, consult with relevant professionals before making a purchase.

Incorrect Pricing or Information

If a product or service is listed at an incorrect price or with incorrect information due to typographical errors, system errors, or supplier errors, AlfareedCard reserves the right to refuse or cancel any orders for such items or services.

Disclaimer on Accuracy

While we strive to maintain accurate information, Alfareed Card does not guarantee that all content is free from errors or that any identified inaccuracies will be corrected immediately.

4. Intellectual Property Rights

4.1 Ownership of Content

All content available through AlfareedCard services — including text, graphics, images, logos, icons, audio, video, software, source code, and design elements (collectively, the “Content”) — is owned or licensed by AlfareedCard and is protected by UAE and international copyright, trademark, and other intellectual property laws. You acknowledge that:

AlfareedCard and its licensors retain all rights, title, and interest in the platform and its Content.
The Services and Content are provided for your personal, non-commercial use only; no ownership or proprietary interest is transferred to you.
Unauthorized use, reproduction, distribution, modification, display, or creation of derivative works from any portion of the platform or Services is prohibited without prior written permission.

4.2 Limited License

AlfareedCard grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes only. This license permits you to:

Access and view the Content and materials on the platform.
Make personal purchases of products or services offered.
Download or print portions of the Content for personal, informational, and non-commercial purposes, provided copyright or proprietary notices are not removed.

4.3 Restrictions on Use

This license does not permit you to:

Modify, copy, reproduce, republish, upload, post, transmit, sell, distribute, or create derivative works from any Content or source code.
Use data mining, scraping, or automated methods to collect Content.
Use any trademarks, logos, or proprietary content for commercial purposes without written consent.
Frame or otherwise enclose AlfareedCard content without authorization.

All rights not expressly granted are reserved by AlfareedCard and its licensors. Unauthorized use automatically terminates the license and may violate applicable intellectual property laws.

4.4 Trademarks and Branding

The name AlfareedCard and all associated logos, service marks, product names, graphics, icons, and slogans are registered or unregistered trademarks of AlfareedCard or its licensors. You may not use the Marks without prior written consent or in a way likely to cause confusion, disparage, or discredit AlfareedCard.

4.5 Reservation of Rights

Alfareed Card reserves all rights not expressly granted to you. Access to and use of the Services does not confer any rights to content, features, or functionalities except as explicitly permitted. Unauthorized use may result in termination of access and civil or criminal liability.

4.6 Copyright Complaints

If you believe your copyrighted work has been used without authorization on AlfareedCard, you may submit a complaint to our designated copyright agent. Complaints must include:

Physical or electronic signature of the copyright owner or authorized representative.
Identification of the copyrighted work and the allegedly infringing material.
Contact information of the complainant.
Statement of good faith belief that the use is unauthorized.
Statement of accuracy under penalty of perjury.

Upon receipt, we will investigate and, if appropriate, remove or disable access to the allegedly infringing material. False or misleading notices may result in liability.

5. Pricing and Payment Terms

5.1 Pricing Accuracy

AlfareedCard strives to ensure that all prices displayed on the platform are accurate and up-to-date. However, errors may occur due to typographical mistakes, system glitches, or supplier updates. In such cases, we reserve the right to correct the error and adjust the price accordingly, even after an order has been placed.

5.2 Payment Methods

You may complete purchases using the payment methods provided on the platform. All payments are processed securely through trusted third-party payment providers. By submitting payment information, you authorize AlfareedCard and its payment processors to charge your chosen payment method for the total amount of the transaction, including applicable taxes and fees.

5.3 Payment Security

We prioritize the security of your financial information. Sensitive payment details such as credit/debit card numbers are encrypted and handled only by secure, PCI DSS-compliant payment gateways. AlfareedCard does not store complete payment card information on its servers.

5.4 Billing and Confirmation

Upon successful payment, you will receive an order confirmation via email or in-app notification. The confirmation represents acknowledgment of your purchase and serves as your receipt. Please review your order details carefully and contact our Customer Support Team immediately if there are any discrepancies.

5.5 Refunds and Cancellations

Refunds, cancellations, and order modifications are governed by our Refund and Return Policy. Promotional credits, discounts, or wallet balances used for purchases are subject to the conditions outlined in that policy. AlfareedCard reserves the right to refuse refunds for items or services not eligible under the stated terms.

5.6 Currency and Taxes

Prices displayed on AlfareedCard are in the currency specified on the platform. Any applicable taxes, duties, or other charges are your responsibility and will be calculated and applied during checkout. You agree to comply with all local tax obligations related to your purchases.

5.7 Unauthorized Transactions

You are responsible for maintaining the confidentiality of your account and payment information. AlfareedCard will not be liable for unauthorized transactions resulting from your failure to protect your account credentials. If you suspect any unauthorized activity, you must notify us immediately.

5.8 Pricing Changes

AlfareedCard reserves the right to modify prices, fees, or charges for any product or service at any time. Updates will be reflected on the platform, and your continued use of the Services constitutes acceptance of such changes.

6. Limitation of Liability

To the maximum extent permitted by applicable UAE law, AlfareedCard, its affiliates, directors, officers, employees, agents, and service providers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, revenue, data, or business opportunities — arising out of or related to your use of, or inability to use, our platform.

Service Availability

While AlfareedCard strives to provide uninterrupted access to our Services, we do not guarantee continuous, error-free, or secure operation. Access may be limited or unavailable due to maintenance, technical issues, or factors beyond our control. AlfareedCard shall not be liable for any losses or damages resulting from service interruptions or delays.

Third-Party Content and Links

The platform may include content, offers, or links provided by third parties. AlfareedCard does not endorse, guarantee, or assume responsibility for the accuracy, reliability, or legality of third-party content or services. Any dealings or transactions with third parties are solely between you and the third party.

User-Generated Content

Alfareed Card is not responsible for the conduct, accuracy, or legality of content uploaded, shared, or communicated by other users. You acknowledge that all interactions with other users are at your own risk, and Alfareed Card disclaims any liability for user-to-user communications or transactions.

Digital Goods and Products

Due to the nature of digital products such as cards, games, or eSIMs, we cannot guarantee compatibility, availability, or uninterrupted access for all devices or platforms. AlfareedCard shall not be liable for any loss, corruption, or technical issues affecting digital products once delivered, except as required by applicable consumer protection laws.

Nothing in these Terms excludes or limits liability that cannot legally be excluded under applicable UAE law, including liability for death or personal injury caused by negligence or fraud.

Indemnification Requirement

You agree to indemnify, defend, and hold harmless AlfareedCard, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising from your violation of these Terms, misuse of the platform, or infringement of any third-party rights.

7. Disclaimer of Warranties

AlfareedCard provides its platform, digital products, games, eSIMs, and related services on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

Digital Products and Compatibility

While we make every effort to ensure the quality and functionality of digital products, AlfareedCard does not guarantee that any digital card, game, or eSIM will meet your specific requirements, be compatible with all devices, or operate without interruption, error, or security vulnerabilities.

Accuracy of Content

We strive to provide accurate, complete, and up-to-date information regarding all products and services. However, AlfareedCard makes no representations or warranties that the information on the platform is accurate, reliable, complete, or current, and we are not responsible for errors or omissions in product descriptions, pricing, or availability.

Third-Party Services

The platform may contain links or access to third-party services. AlfareedCard does not warrant, endorse, or assume responsibility for the content, functionality, or policies of any third-party services. Your use of third-party services is at your own risk.

Limitation of Remedies

To the maximum extent permitted by law, any claims you may have regarding the Services, products, or content shall be limited to the amount you paid, if any, for the specific product or service giving rise to the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless AlfareedCard, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

Your use of or access to the AlfareedCard platform, Services, or products.
Any violation of these Terms and Conditions or applicable laws, rules, or regulations.
Any breach of your representations, warranties, or obligations under these Terms.
Your conduct, content, or communications with other users, including user-generated content or transactions.
Any infringement or misappropriation of third-party intellectual property rights or other proprietary rights resulting from your actions.

Defense of Claims

You agree to cooperate fully with AlfareedCard in the defense of any claims or disputes. AlfareedCard reserves the right, at its own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to provide all reasonable assistance as requested.

Limitation on Indemnification

This indemnification obligation applies regardless of whether the alleged liability arises from negligence, action, or inaction, except where prohibited by law.

9. Dispute Resolution & Governing Law

9.1 Governing Law

These Terms and your use of the AlfareedCard platform and Services are governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of laws principles.

9.2 Informal Resolution

Before initiating any formal dispute, you agree to first contact our Customer Support Team at [email protected] to attempt to resolve any issues amicably. Most concerns can be resolved through communication, and we encourage you to provide detailed information regarding the problem.

9.3 Formal Dispute Resolution

If informal resolution fails, any dispute, claim, or controversy arising out of or in connection with these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts of the Emirate of Dubai, UAE. Alternatively, parties may agree to binding arbitration administered by the Dubai International Arbitration Centre (DIAC) under its applicable rules.

Jurisdiction: Courts of the Emirate of Dubai, UAE Alternative: Dubai International Arbitration Centre (DIAC) Language of Proceedings: Arabic or English Limitation Period: Claims must be brought within one (1) year from the date the cause of action arises.

9.4 Waiver of Class Action

You agree that any arbitration or dispute resolution will be conducted on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative proceeding against AlfareedCard.

9.5 Limitation Period

Any claims or disputes must be brought within one (1) Day from the date the cause of action arises, or they will be barred.

9.6 Exceptions

Nothing in this section prevents Alfareed Card from seeking injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property, confidential information, or other proprietary rights.

9.7 Finality of Decision

Any arbitrator’s decision shall be final, binding, and enforceable. The prevailing party shall be entitled to recover reasonable attorney’s fees and costs, to the extent permitted by applicable law.

10. Termination

10.1 Termination by AlfareedCard

AlfareedCard reserves the right, at its sole discretion, to suspend or terminate your access to the platform, Services, or your account at any time, with or without prior notice, for any reason, including but not limited to:

Violation of these Terms and Conditions or applicable laws.
Engaging in prohibited or fraudulent conduct.
Non-payment or payment disputes.
Threats to the security, functionality, or integrity of the platform.
Any behavior that may cause harm, disruption, or inconvenience to other users or the business.

10.2 Termination by User

You may terminate your account at any time by discontinuing use of the Services and following the account closure procedures available on the platform. Termination does not relieve you of obligations incurred prior to termination, including payment obligations, dispute resolution, or indemnification responsibilities.

10.3 Effect of Termination

Upon termination, the following will apply:

Your right to access and use the Services will immediately cease.
Any pending transactions, orders, or subscriptions will be subject to our policies, including refund eligibility.
Certain information, such as transaction history or legal records, may be retained for legal, accounting, or regulatory purposes.
All licenses granted to you for accessing content or digital products will automatically terminate.

10.4 Survival of Terms

Provisions that by their nature should survive termination — such as disclaimers, limitation of liability, intellectual property rights, indemnification, and dispute resolution — will remain in full force and effect.

10.5 Notification

Whenever feasible, AlfareedCard will notify you of account suspension or termination; however, we are not obligated to provide prior notice in cases of serious violations, security threats, or legal obligations.

11. Third-Party Links & Resources

The AlfareedCard platform may include links, advertisements, offers, or access to third-party websites, applications, services, or resources (“Third-Party Services”). These links are provided solely for your convenience and informational purposes.

No Endorsement or Warranty

AlfareedCard does not control, endorse, or guarantee any Third-Party Services. We are not responsible for the content, products, services, privacy policies, or practices of third parties, and inclusion of any link does not imply approval, sponsorship, or affiliation.

User Responsibility

Your interactions with Third-Party Services are solely between you and the third party. You acknowledge and agree that AlfareedCard shall not be liable for any loss, damage, or dispute arising from such interactions, including transactions, content, or technical issues.

Security and Compliance

Third-Party Services may have different terms, conditions, and privacy practices. We encourage you to review and understand these policies before using any third-party platform. AlfareedCard makes no representations regarding the security, accuracy, legality, or availability of such services.

Limitation of Liability

You agree that Alfareed Card will not be responsible or liable for any loss or damage of any kind incurred as a result of your dealings with third-party websites, services, or resources.

12. Force Majeure

AlfareedCard shall not be held liable or deemed in breach of these Terms for any delay, failure, or inability to perform its obligations resulting from events beyond our reasonable control (“Force Majeure Events”). These include, but are not limited to:

Natural disasters, storms, floods, fires, earthquakes, or other acts of God.
War, terrorism, civil unrest, riots, or governmental actions.
Pandemics, epidemics, or public health emergencies.
Internet, network, or communication failures outside of our control.
Power outages, technical failures, or cyberattacks.
Strikes, labor disputes, or disruptions affecting our suppliers or service providers.

During a Force Majeure Event, AlfareedCard may suspend or delay performance of its obligations without liability. Deadlines and delivery commitments may be extended for the duration of the event. We will make reasonable efforts to notify users if a Force Majeure Event significantly impacts our Services and resume normal operations as soon as possible.

By using the platform, you acknowledge and accept that Force Majeure Events may affect access, delivery, or availability of products, digital cards, games, or eSIM services, and that Alfareed Card shall not be responsible for any resulting loss or inconvenience.

13. Modifications to the Terms

AlfareedCard reserves the right, at its sole discretion, to modify, update, or revise these Terms and Conditions at any time. Changes may be made to reflect updates in our services, legal requirements, business practices, or industry standards. When changes are made, the updated Terms will be posted on the AlfareedCard platform with the “Last Updated” date clearly indicated.

Your continued access to or use of AlfareedCard after the posting of revised Terms constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you must immediately stop using the platform and, if applicable, close your account.

It is your responsibility to regularly review the Terms to stay informed of any modifications. If any provision of the updated Terms is deemed invalid or unenforceable under applicable law, it will not affect the validity or enforceability of the remaining provisions.

14. General Provisions

Entire Agreement: These Terms and Conditions, together with our Privacy Policy and any other legal notices published by AlfareedCard, constitute the entire agreement between you and AlfareedCard regarding your use of our Services. They supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral.
No Waiver: The failure of AlfareedCard to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be explicitly provided in writing and signed by an authorized representative of AlfareedCard.
Severability: If any provision of these Terms is determined to be unlawful, void, or unenforceable for any reason, that provision shall be considered severable from the remaining Terms, which will continue in full force and effect.
Assignment: You may not assign or transfer your rights or obligations under these Terms without prior written consent from AlfareedCard. AlfareedCard may freely assign or transfer its rights and obligations under these Terms without restriction.
No Agency Relationship: Nothing in these Terms creates an agency, partnership, joint venture, or employment relationship between you and AlfareedCard. You may not represent yourself as an agent, employee, or representative of AlfareedCard.
Headings: Headings used in these Terms are for convenience only and shall not affect the interpretation or meaning of any provision.
Language: In the event of any conflict between the English and Arabic versions of these Terms, the Arabic version shall prevail for disputes subject to UAE jurisdiction.
